Damages for Emotional Distress

If the circumstances of your termination were particularly distasteful (in terms of the manner in which the dismissal itself was carried out), there may be compensation available. The extra compensation is often called bad faith damages. The purpose of bad faith damages is to punish the employer for some type of wrongdoing, rather than to compensate you for the loss of your job. The factors the Courts consider when determining whether an award of bad faith damages is appropriate include:

1. Whether the termination was carried out in a particularly offensive way
2. Whether allegations of cause for termination are maintained without justification
3. Whether you were fairly dealt with upon termination – including such things as all outstanding pay being provided
4. Whether the employer failed to provide you with a letter of reference
5. Whether the employer has taken steps that will impact your ability to find replacement employment

You could also get damages for emotional distress (also called aggravated damages), and punitive damages. However, bad faith, aggravated, and punitive damages are extremely rare in Canada. If you think you should be entitled to one of these forms of damages, consult a lawyer. Be aware that courts expect an employee to go through an emotionally difficult time when being dismissed. The fact that an employer has to give you the bad news that you’ve lost your job is not in itself reason to claim damages for emotional distress. Neither is the fact that the employer may give you some reasons why they’ve had to let you go. Courts recognize that getting fired is distressful in any situation. Therefore, bad faith, aggravated, and punitive damages are reserved for the truly exceptional cases – cases that some might say border on abusive.Jeannie Stewarthttps://www.blogger.com/profile/01649125089745793517noreply@blogger.comtag:blogger.com,1999:blog-6570937149426837504.post-45709263834213637642010-09-18T12:13:29.386-07:002010-09-18T12:13:29.386-07:00and the way EI sees it, it was not a layoff, i did...and the way EI sees it, it was not a layoff, i did not quit, therefore to them it is "fired"Jeannie Stewarthttps://www.blogger.com/profile/01649125089745793517noreply@blogger.comtag:blogger.com,1999:blog-6570937149426837504.post-79978899913252984612010-09-18T12:12:38.237-07:002010-09-18T12:12:38.237-07:00yes, the 3 month rule does not apply in discrimina...yes, the 3 month rule does not apply in discrimination cases....Jeannie Stewarthttps://www.blogger.com/profile/01649125089745793517noreply@blogger.comtag:blogger.com,1999:blog-6570937149426837504.post-84245162697279809282010-09-18T12:11:38.937-07:002010-09-18T12:11:38.937-07:00is it really technically firing if it is within 3 ...is it really technically firing if it is within 3 month probation period?Anonymoushttps://www.blogger.com/profile/14903898995122979179noreply@blogger.comtag:blogger.com,1999:blog-6570937149426837504.post-84535656585124594422010-09-18T11:55:28.246-07:002010-09-18T11:55:28.246-07:00do we get damages in Canada for emotional stress? ...do we get damages in Canada for emotional stress? because, i really am even more of a basket case lately lol....Jeannie Stewarthttps://www.blogger.com/profile/01649125089745793517noreply@blogger.comtag:blogger.com,1999:blog-6570937149426837504.post-75558004833480280612010-09-18T11:52:51.517-07:002010-09-18T11:52:51.517-07:00And emotional stress, and pain and suffering, and....And emotional stress, and pain and suffering, and...!
I know it's not about the money Jeannie. You proved me right.

You have had all sorts of jobs, and been able to meet the challenges of those jobs. You've taken care of kids of all ages, without any problems. You've gone through school, including post secondary courses, and I'm sure have surprised classmates and educators of your abilities. You are raising 2 kids, running a house, working multiple jobs, and managing just like anyone else would. Even better I would say, I couldn't handle all of that. In short, you are amazing.

Don't let anyone hold you back; and if they try, KICK ASS!!!!!!!!!!!!

Now go dry your eyes, cause I know this made you teary. :)

ShelleyAnonymousnoreply@blogger.comtag:blogger.com,1999:blog-6570937149426837504.post-82327620685755015552010-09-15T19:30:44.844-07:002010-09-15T19:30:44.844-07:00That guy is a moron and deserves what he gets.

Discriminatio...Jeannie, take this all the way man. Discrimination is illegal and I don't believe they can legally fire you if you proved you could do the job. While you may be told you should have presented your "disability" during the interview, the fact of the matter is, you were hired, you proved yourself and you did discuss the matter with your boss the first day. He appeared to agree to give you a fair chance, then let you go. The fact that he flat out told you it was because of your arm is I think what may sink him. Not sure about SK, but it's got to be similar to AB and in AB an employer can let an employee go without giving a reason and with no notice during the first 3 months; however, they are NOT allowed to let an employee go due to discrimination at any time. (At the very least, the negative publicity will make the guy squirm!!) Good luck and please keep us posted! So many people will be cheering you on, and if you fight and win this it will be an amazing win for so many who face the same types of discrimation. You have a lot of people behind you in this!!!Erinnoreply@blogger.com
